KLAW ROOFTOP TERMS & CONDITIONS

EVENT CONFRIMATION

To confirm your event, and reserve the designated area please confirm your menu selections and event details by electronically signing this event contract. Please ensure all pages are completed, signed and returned in order to finalize your reservation. Once all required signed documents are received and processed, your event and space reservation will be confirmed by your event sales manager.


DEPOSIT/PAYMENT

A 50% deposit of the estimated total is required to reserve your event. Deposits will be deducted from the final bill and the remaining balance is due upon completion of the event. Deposits are non-refundable, but an event date change can be made in writing one month before your event is scheduled. Forms of payment accepted are American Express, Master Card, Visa, Discover, personal or corporate checks, and wire transfers. A credit card may be kept on file to close the event but must be specified ahead of time with the even sales manager. A photo ID is required for all credit card authorizations. The grace period to contest the charges on the final bill from the event is three (3) business days. *Your event is not considered reserved until Klaw Miami receives the agreement electronically signed and cleared funds for deposit along with proper identification. Klaw Miami reserves the right to change the contracted space due to weather or unforeseen circumstances. Any changes will be done in the best interest of the client’s expectation.


GUEST COUNT/GUARANTEE

Final guest count/guarantee is due (3) three business days in advance of special event. Client shall not be entitled to any discount, refund or deduction from the charges or fees if the guest count is less than the guaranteed. If, on the day of the event, the attendance varies from the final count, the client will be charged based on the greater number of guests.


FEES

The final bill is subject to an 8% tax, 20% service charge, and a 3% administrative fee. Additional fees may be added to the agreement based on specifications per event (i.e. Labor charges, rental fees, venue fees, etc.).


CANCELLATIONS

If Client chooses to cancel the event at least ten (10) business days prior to the event date, client will not be subject to any additional charges (please reference the DEPOSIT/PAYMENT section). If Client chooses to cancel the event anytime that is less than (10) business days prior to the event date, client will be charged the full cost of the event as a cancellation fee, time being of the essence. Fifty percent (50%) of the cancellation fee may be used as a credit by Client toward re-booking within one (1) year at Klaw Miami, dates are subject to availability. Cancellation notice must be submitted in writing to the Special Events Department via email to: a.cohen@klawrestaurant.com


FORCE MAJEURE- COVID 19 CLAUSE

If client is unable to conduct the event due to a documented issue relating to a COVID-19 outbreak (e.g., a quarantine, a guest infection, or a federal, state or municipal order banning an event or gathering of the type to be conducted) (a “COVID-19 Cause”), client may cancel the event by providing written notice to Klaw Miami as soon as possible, but not later than ten (10) business days prior to the event date, time being of the essence. In the event of a timely cancellation in accordance with the preceding sentence, the client will receive a full refund of deposits made under this contract. In the event client cancels the event in writing due to a COVID-19 Cause less than ten (10) business days prior to the event date, the client will forfeit the deposit, or choose to rebook with a calendar year. Further, Klaw Miami reserves the right to cancel the event at any time, including on the event date, due to a COVID-19 cause or any other reason it deems reasonably necessary in order to protect the health and welfare of its guests and employees. In the event of a cancellation for any reason set forth in this paragraph, the client will receive a full refund of deposits made under this agreement.

MENU SELECTIONS

Our Director of Sales and Events will be happy to plan a personalized menu with you in order to meet your specific needs. We will also make every effort to accommodate your dietary requests. Menu prices are subject to change. However, pricing will be guaranteed for any event with a signed contract. Menu selections are required (10) business days prior to your function. Availability of menu selections made within five (5) business days will not be guaranteed.


FOOD AND BEVERAGE

Klaw Miami prohibits any food and beverage procured from outside sources with the exception of cakes with a $10 plating fee charge per slice person. Kosher meals may be brought in if approved by the restaurant (charges apply). Wines that are not on our wine list may be brought in with a corkage fee of $75 per standard (750ml) bottle, up to 2 bottles. A magnum (1.5 liters) bottle has a corkage fee of $150, only 1 bottle is permitted.


BEVERAGE SERVICE

All beverages are sold on a per drink basis. Cash and hosted arrangements are available as well as beverage packages. In order to ensure availability, wine selections are to be submitted (1) week prior to your event date.


FOOD & BEVERAGE MINIMUM GUARANTEE

Events booked with a food and beverage minimum must meet required sales stipulated on the contract. If the food & beverage minimum is not met then the balance remaining will be charged to the final bill. Credits, gift certificate vouchers, wine and food to go are not offered “to go” if food and beverage minimum is not met.


TIMELINE

All events are subject to three (3) hours, unless otherwise agreed to and negotiated on this agreement. An additional charge of $1000.00 will be added to the final bill for each additional (30) thirty minutes past contracted reservation time and/or any part thereof. Each reservation is allotted a maximum of 3 hours regardless or arrival time.


DECORATIONS SIGNAGE & RULES

Tabletop decorations, centerpieces or any other personal decorations should be presented and approved in advanced by the event sales manager. Decorations must meet local fire department, health department, and any other governmental regulation. Nothing may be affixed to the walls or the ceiling of the restaurant. All outside items brought into the restaurant need to be listed and sent to Klaw Miami at least a week before the event to ensure approval of each individual item.


 OUTSIDE VENDORS & PROMOTIONAL OFFERS

Host may hire outside vendors for various reasons (rentals, linen, flowers, decor, etc.). Host is responsible for coordinating with vendor and Klaw Miami to coordinate a drop off time and pick up time. Host is responsible for payment directly to the vendor, Klaw Miami is not responsible for any payments or damage charges owed to outside vendor. Host must make sure everything has been pre-approved by Klaw Miami Sales & Events Director  before confirming anything to be delivered. A COI must be presented and Krilov, LLC must be added to each vendor’s insurance policy as an additional insured party. Promotional offers, gift certificates, discount offers may not be applied towards special events.


PARKING INFORMATION

Klaw Miami is not responsible for any kind of parking before, during, or after events. Guests are responsible for their own parking. Most common options include Valet Parking or city metered parking.


CONDUCT

You acknowledge that the host of the event agrees to communicate to all event guests that they must s drink responsibly and maintain a reasonable noise level that respects the ambiance and atmosphere for others in the restaurant. Klaw Miami management reserves the right to prohibit the consumption of alcohol by any or all guests attending the event should management deem it necessary for safety reasons. Klaw Miami also reserves the right to require proof of appropriate age from any and all guests before serving alcoholic beverages. No outside alcohol is permitted on property and there is no smoking indoors.


HOST RESPONSIBILITY

Should Klaw Miami incur any physical damage to the property before (set up), during or after the event (breakdown) and said damage is a direct result of the activity of event guests or vendors contracted privately by the host, by signing below, you acknowledge that as the host of the event (or on behalf of), the host will be responsible for reimbursing Klaw Miami for any and all damages incurred. Klaw Miami cannot be held responsible and reserves the right to cancel this agreement, for any disruption of your event due to war, weather, civil disturbance, or an act of God. This Agreement may be amended only in writing and signed by a Klaw Miami representative.
